Title VII of the Civil Rights Act of 1964 bars employers from discriminating in employment decisions on the basis of an individual's race. It provides that "it shall be an unlawful employment practice for an employer ... to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual's race, color, religion, sex, or national origin." This applies to employers with fifteen or more employees. However people who work for smaller employers are usually protected by similar state anti-discrimination laws. Wrongful TerminationDifferent types of racial discrimination include: racial harassment, failure to hire or promote, creation of a racially hostile work environment, unequal compensation, benefits, job assignments, training, and wrongful termination of employment due to race. Signs of a racially hostile work environment may include degrading language, graffiti, and racial slurs and epithets. If race was a motivation in an employers decision to terminate an employee, this can constitute a wrongful termination on racial grounds.
